2.  In addition, Waves is the legitimate owner of its registered trademarks in China, which include without limitation, “WAVESAUDIO” and the logo of Waves “

此外，Waves是其中国注册商标的合法权利人。Waves在中国的注册商标包括但不限于“WAVESAUDIO”和Waves的标志“

3.  The accessible public channels operated by Waves in China are as follows:

1) the official website (www.waves.com);

2) the WeChat official account WavesAudio (ID: Waves_Audio); and
微信官方公众号WavesAudio（ID：Waves_Audio）；以及

3) the Bilibili account WavesAudio (ID: space.bilibili.com/509094846).

4.  Other than the channels above, we do not operate and have never appointed or authorized any agent, distributor, or service provider to operate social media accounts and online stores in China on behalf of Waves.

除上述渠道外，我们从未运营、也从未指定或授权任何代理商、经销商或服务提供商代表Waves在中国运营任何社交媒体账户和在线商店。

5.  Waves has become aware recently that there are channels now using the title “Waves China” in public without authorization from us. Such unauthorized use misleads customers and the public and causes confusion that Waves is somehow connected to such unauthorized channels.

Waves于近期发现，部分渠道在未经我们授权的情况下，现公开使用“Waves 中国”的名称。该等未经授权的使用误导消费者和公众，使其认为Waves与该等未经授权的渠道存在一定程度的关联。

6.  For avoidance of doubt, without authorization from Waves, no entities are allowed to use the titles “Waves China” “Waves Official” or any other similar terms in any language, to indicate or imply the source of sales service and to mislead the customers and members of the public about the identity of the operator of social media accounts, online stores, etc.

为免疑义，未经Waves授权，任何主体均不得以任何语言使用“Waves中国”“Waves官方”名称或任何其他类似的用语，以借此表示或暗示服务来源，并误导消费者和公众对社交媒体账号、在线商店等的运营者身份的认识。

 

Legal Consequences and Demand
法律后果和要求

7.  According to the Trademark Law, the Anti-Unfair Competition Law and relevant rules promulgated, any unauthorized use of registered trademarks and brands will be deemed as infringement of exclusive rights to use registered trademarks, and may constitute an act of unfair competition. Such authorized use seriously impairs the legitimate rights of Waves and shall be subject to civil, administrative and even criminal liabilities as set out by the laws.

根据《中华人民共和国商标法》《中华人民共和国反不当竞争法》以及已颁布的相关规定，未经授权使用注册商标和品牌名称将被认定为侵犯注册商标专用权，并可能构成不正当竞争。该等未经授权的使用严重侵害Waves的合法权利，应承担法律规定的民事、行政甚至刑事责任。
  
8.  We hereby demand all unauthorized channels to:

我们在此要求所有未经授权的渠道采取如下行动：

1) immediately stop using the trademarks and brands owned by Waves in any way without authorization from Waves;
立即停止以任何方式，非经Waves授权使用Waves拥有的商标和品牌名称；

2) remove, in 5 days upon receipt of this statement, any use of the trademarks and brands owned by Waves in their logos, shop names, social media account names, shop/account introductions, or in any other identification banners, titles, decorations, etc.
在收悉本声明后的5日内，移除在其标志、店铺名称、社交媒体账号名称、店铺/账号介绍，或其他任何标识性的横幅、名称和装饰等中使用的Waves的商标和品牌名称。

9.  It is our policy not to tolerate any form of unauthorized use. Should unauthorized channels fail to make corrections within a reasonable period from the release of this statement, Waves will take every possible means to protect its lawful rights, including without limitation, lodging complaints with the relevant market regulation authorities and filing litigation at local courts, without further notice.

我们不会容忍任何形式的未授权使用。如果未经授权的渠道未能在本声明发布后的合理期限内纠正其违法行为，Waves将采取一切可能的手段保护自身合法权利，包括但不限于向相关市场监督管理机关投诉，向当地法院起诉等。届时恕不另行通知。

 

Reminder to Customers and General Public
对消费者和公众的提示

10.  Waves wishes to remind customers and/or members of the public not to mistake the unauthorized channels for Waves’ official ones; nor disclose any personal information without verification of the identity(ies) of the related websites, social media, online shops or mobile app operator(s). Customers are also encouraged to contact the official channels of Waves to report unauthorized channels or suspicious infringements.

Waves希望提醒消费者和/或广大公众，请勿将未经授权的渠道误认为Waves的官方渠道，也请勿在未核实有关网站、社交媒体、在线商店或移动应用程序运营者身份的情况下向其披露个人信息。同时，我们鼓励消费者联系Waves的官方渠道，以告知其发现的未经授权的渠道或可能存在的侵权行为。

With constant support from genuine users and multiple parties, Waves has achieved significant success in China market in the last few years. We shall proceed with creative products and fight against infringements.
